Summary of key terms and conditions

Length of your membership

Your Foundation Membership has an initial minimum commitment term of 12 months (52 weeks), from your membership start date. Once the initial minimum commitment term has been reached, your membership will continue to auto-renew every fortnight, unless it is terminated by you or us in accordance with the termination conditions outlined in this agreement.

Membership fees

Your membership included a joining fee of $49.30 (not applicable to existing Hume Leisure Centre members), and membership fees now of $40.95 per fortnight from Monday 1 July 2022.

Paying for your membership

You will authorise our direct debit provider EziDebit, to deduct your membership fees fortnightly from your nominated debit or credit card.

Your health and safety

You agree to complete our new member’s pre-exercise survey, and provide us with any relevant health and fitness information that might affect your ability to use our facilities. When using our facilities, you must ensure you are in good physical condition and are aware of no medical or other reason that would prevent you from exercising. If you are unsure, you will seek medical advice.

Suspending your membership

You may suspend or defer your membership for a minimum period of two weeks and a maximum of three months during a 12-month period.

Suspensions and credits for medical reasons are available when;

  • a valid medical certificate which includes the relevant date range is provided, and
  • the member has not attended the facilities during this period

Transferring your membership

Your Foundation Membership cannot be transferred to another person.

Cancelling your membership

If you wish to cancel your membership, you'll need to provide 14 days’ notice via the Splash request form

Minimum age

You must be 18 years or over to be a Foundation Member.

Word: Membership, Foundation Membership Application
Meaning: Foundation Membership. This is an agreement between Splash Aqua Park and Leisure Centre and you, under which you will become a member of Splash Aqua Park and Leisure Centre.

Word: Initial minimum commitment term
Meaning: The minimum length of time specified in the online Foundation Membership Application form.


Our agreement

  • These Terms – together with the conditions of entry and use of our facility – make up the terms of a Membership Agreement between you and Splash Aqua Park and Leisure Centre (Hume City Council – ABN 14 854 354 856).
  • It is important that you have read and understood all of the terms and conditions of the Agreement before agreeing to these Terms. Please contact us you have any questions.

When your membership starts

  • Your membership commenced upon the opening to the public of Splash Aqua Park and Leisure Centre.

The length of your membership

  • Your Foundation Membership has an initial minimum commitment term of 12 months (52 weeks), from your membership start date.
  • Once the initial minimum commitment term has been reached from Tuesday 2 October 2018 your membership will continue to automatically renew every fortnight, unless it is terminated by you or us in accordance with the termination conditions outlined in this agreement.

Health and safety

  • When you use our facilities, you warrant that you are in good physical condition. You will not use our facilities if you know of any medical or other reason why you should not undertake physical activity. If you are unsure, please seek medical advice from your doctor.
  • You agree to give us all relevant personal, health and fitness information both before and during the course of any exercise program or other activity which may affect your ability to use facilities or exercise equipment within the centre. You also agree to complete our Pre-Exercise Survey. Depending on how you answer the survey, in some cases, we may ask you to get further medical advice before using the facility.

  • You acknowledge that our Pre-Exercise Survey or other screening does not substitute medical advice and guarantee against injury or death.

  • You warrant that information you give us will be true and accurate and not misleading in any way.

  • You agree to not use our facilities if you are suffering from any form of illness, disease, injury or other condition that could be a risk to your health or safety, or that of other members and guests.

Suspending your membership

  • If you wish to suspend your membership, you must notify us in writing; by completing a Splash request form
  • You may suspend or defer your membership for a minimum period of two weeks and a maximum of three months in a 12 month calendar period.


Cancelling your membership

  • You provide 14 days’ notice in writing and fill in the Splash request form. We will then be in contact within 2 business days.

Fees

Joining Fee

  • Our Joining Fee covers the administrative costs for your establishing your membership. This fee is payable by new members upon commencement of membership and is non-refundable.
  • This fee is not applicable to existing members of Craigieburn Aquatic and Leisure Centre, Broadmeadows Aquatic and Leisure Centre and Sunbury Aquatic and Leisure Centre who upgrade or transition their membership to Splash Aqua Park and Leisure Centre.
  • Fees may be subject to change at 1 July, each year.

Membership Fees

  • The total cost of Foundation Membership is $946.40 for the initial minimum commitment term to 12 months.
  • Your Membership Fees are payable in 26 fortnightly direct debit payments, from your membership start date.
  • You must continue to make payments until the end of your minimum commitment term.
  • If you do not make any payment when it is due, your membership may be suspended and you may be refused access to our centre until the outstanding balance has been settled. Fees and charges may continue to accrue if your membership has been suspended with outstanding fees.
  • Your Membership may also be terminated by us if your Membership Fees remain unpaid for an extended period. You will still be liable for all unpaid amounts and we may engage the services of a debt collection agency to recover any outstanding amounts owed to us.

Direct Debit

  • Foundation Membership fees are only payable by direct debit from your nominated debit or credit card account.
  • When completing your membership application, you will be required to make a Direct Debit Payment Agreement with our biller EziDebit Pty Ltd (ACN 096 902 813).
  • The Direct Debit Payment Agreement is separate to this Agreement.
  • By nominating a credit or debit account, you authorise EziDebit to deduct all fees and charges applicable under this Agreement.
  • You must keep your account details up to date and ensure there are sufficient funds in your account on the usual payment day, or the next working day if that falls on a day when your nominated financial institution does not process payments.
  • If there are insufficient funds in your nominated account on the usual payment day, or there is another reason your account was unable to be debited (except one within the Biller’s control), you may be charged a dishonour fee, and this would be added to your next debit amount.
  • If your direct debit payment is declined, you will need to pay your outstanding balance in centre upon your next visit. Any outstanding payment remaining on your next scheduled direct debit date will be deducted from your nominated account. Access to the Centre will be denied while an outstanding balance exists

Fee increases

  • All Splash Aqua Park and Leisure Centre fees and charges are set and approved each financial year by Hume City Council.
  • All fees and charges are set for a period of 12 months (July to June) each financial year.
  • Should you elect to renew your Foundation Membership, the associated fees may change.
  • We will communicate to all members in advance to notify of any change.
  • If your fees are varied, this Agreement authorises any debits from your nominated account to also be varied.

Security

Staffed hours
  • The centre is staffed between the hours of 5.30am-10pm on weekdays and 8am-5pm on weekends.
  • These hours may be altered during public holidays - so please refer to our website for our opening hours.
Non-Staffed hours
  • Our 24/7 gym will not be staffed between the hours of 10pm-5.30am on weekdays and 5pm-8am on weekends.
Operation of 24/7 CCTV surveillance
  • The centre is subject to closed circuit television camera (CCTV) surveillance, 24 hours a day.
  • The centre is also subject to remote video and other security services. However, this is not a guarantee against all instances of harm.
  • The CCTV system is used for security purposes and is managed in accordance with Council’s CCTV camera policy, which control storage of and access to recorded images.
Emergencies
  • The centre has an emergency phone, Personal Duress lanyards for safety and security reasons and to alert emergency services, for example, if you are, or feel, threatened or need medical attention.
  • If you deliberately use Personal Duress lanyard inappropriately (as determined by Hume City Council), you agree to pay for any costs, loss or damages incurred because of this inappropriate use.
  • In the event of a serious emergency outside of staffed hours, please contact emergency services on 000.

Inappropriate conduct

Use of illicit substances

  • You acknowledge that the distribution or use of illegal or performance enhancing drugs is illegal and will not use or distribute these substances in our centre or within Craigieburn ANZAC Park.

Consequences for inappropriate conduct

  • You will not behave in a reckless manner, such as threatening or harassing others, damaging equipment, distribute or use illicit substances, or engage in personal training of other members. If you do so, your membership may be immediately cancelled, and you may be banned from joining our centre again.
  • Your membership is not transferrable nor can you lend your membership to anyone else. If you are caught doing this the following consequences will occur. You will recieive a verbal warning from our Customer Service and Duty Manager Team. If there is a repeat of this your membership will be suspended for 2 weeks, if there is a third repeat of this, your membership will be cancelled.


Centre closures

  • We may need to close our centre for a period of time, for example, due to an emergency, to undertake repairs or if required to for legal reasons.
  • We may close our centre up to 7 days in any 30-day period and keep charging Membership Fees. If the centre is closed for more than 7 days we will suspend all membership payments. We may also need to refuse entry to certain areas within our centre during periods of peak demand.
  • We will make every effort to advise our members about any closures via email, phone, on our website and/or across our social media platforms.

Conditions of Entry and Use

By entering Splash Aqua Park and Leisure Centre, you agree to adhere to the following terms and conditions:

General conditions
  • You will follow the instructions of Splash Aqua Park and Leisure Centre staff at all times.
  • Smoking and the consumption of alcohol is prohibited.
  • Offensive language, aggressive behaviour, littering, spitting, or being under the influence of alcohol or drugs is not permitted at any time.
  • You must take reasonable care for your own health and safety, and for the health and safety of others.
  • We reserve the right to close any part of the facility at any time at our discretion.
  • You must comply with statutory evacuation drills and training exercises that will be undertaken regularly.
  • You must not wilfully damage any property or equipment.
  • We will not take responsibility for unattended personal items.
  • Mobile phones are not to be used within change rooms.
  • Photography of any kind is not permitted without approval of Centre management.
  • By entering the facility, making use of the facilities or participating in any activities, you do so at your own risk.
  • We reserve the right to refuse entry or evict any person from the centre for any breach of these conditions.
  • You indemnify Hume City Council from and against all actions, costs, claims, charges, expenses, penalties, demands and damages which may be brought, made or claimed against them, from the use of the facilities at the centre.
  • We reserve the right to search bags and belongings on entry and exit.
24/7 Gym
  • You will follow staff instructions at all times.
  • If you advise staff that you intend to use the Gym after operating hours (from 10pm to 5:30am), you agree to undergo an induction to after-hours use of the gym.
  • You must understand how Personal Duress lanyard works and agree to use it only in an emergency.
  • You will wear appropriate footwear and clothing.
  • You will practice good personal hygiene by wiping down equipment when you have finished using it.
  • Limit your time to 30 minutes on our cardio and 10 minutes on our weights equipment during peak times.
  • You can use lockers provided for bags and other personal belongings as management does not take responsibility for unattended personal items.
  • Return weights and other equipment away after use.
  • Do not drop weights.
  • Use safety collars on relevant equipment at all times.
  • You will speak with a member of our staff if you are unsure on how to use our equipment.
  • Group Fitness Studio, Cycle Studio and Mind and Body Studio
  • You will follow staff instructions at all times.
  • Wear appropriate footwear and clothing.
  • You will comply with our strict lateness policy - to ensure a safe and uninterrupted experience for all participants, you will not be permitted to join the class once it has started if you are late.
  • Group fitness classes are available to eligible members who have group fitness classes included in their membership and to guests who have purchased a pass.
  • You will exercise at an intensity that is comfortable for your fitness level.
  • You will consult your instructor before the class if you have a current or previous injury, or need to modify how you do the class
Waterslides
  • You will follow staff instructions at all times.
  • All riders must be a minimum of 1.25 metres tall.
  • You will take note of any additional slide-specific rules, guidelines or recommendations listed on signage prior to entering the waterslides.
  • The following items are not permitted to be worn by persons using the Waterslides:
  • Eye glasses unless securely fixed with head straps
  • Swimming Goggles
  • Loose jewellery, including neck chains and bracelets.
  • Unsecured items in pockets.
  • You will not use cameras or other photographic equipment while on the waterslide.
Aquatic areas
  • You will follow staff instructions at all times.
  • You will not run adjacent to pools, or while in aquatic areas due to the likely slippery surface.
  • Children between 5 and 10 years of age will not be permitted into aquatic areas of the centre unless they are accompanied by a responsible person over 16 years of age.
  • Children under 5 years of age must remain under the direct supervision of a person who is at least over 16 years of age.
  • Any unsupervised children will be removed from the water until the responsible person over 16 years of age returns to supervise them.
  • You acknowledge that:
  • If you visit the facility with babies and/or toddlers, they will be required to wear water-proof aqua nappies at all times.
  • People who suffer from incontinence must also wear water-proof nappies, pants or swimwear.
  • Used nappies will be disposed of in dedicated nappy bins.
  • After using the toilet or changing a nappy, you will wash your hands thoroughly with soap and water
  • If a toilet accident occurs, you will notify our staff promptly.
  • You will take note of any additional pool-specific rules, guidelines or recommendations listed on signage prior to entering Aquatic areas.
Warm water pool
  • You will follow staff instructions at all times.
  • This pool is for gentle exercise and rehabilitation purposes only, no lap swimming is allowed in this pool.
  • Children under 16 years of age are not permitted in the warm water pool, unless authorised by centre management to undertake a prescribed program issued by a medical practitioner.
  • Infants within parent’s arms are permitted under the strict condition that their use does not disrupt the gentle exercise of other users.
  • Sections of this pool may be used for scheduled aquatic programs and public access may be restricted during these times.
  • You will take note of any additional warm water pool-specific rules, guidelines or recommendations listed on signage prior to entering the aquatic area
Spas, Sauna and Steam Room - Conditions of use
  • You will follow staff instruction at all times.
  • Only members and guests aged 16 years and over are permitted to use the spas, sauna and steam room.
  • Membership wrist bands, or casual use bands purchased from reception must be displayed upon request to use the spa, sauna and/or steam room.
  • Do not use the spa, sauna and/or steam room if under the influence of drugs or alcohol
  • Never put your head under water in the spa
  • Appropriate swimming attire must be worn in these areas
  • Reading material such as newspapers, books and magazines, or portable electrical devices are not permitted.
  • You will remain seated in the spas, sauna and steam room.
  • Oils are not permitted into the sauna or steam room.
  • You will report any suspicious or reckless activity to our staff.
  • You will take note of any additional spa/sauna/steam room-specific rules, guidelines or recommendations listed on signage prior to entering the aquatic area
Spas, Sauna and Steam Room - Safe usage
  • The spa, sauna and steam rooms are heated environments and if you are concerned that it may adversely affect your health, we recommend you seek medical advice prior to use
  • If you are pregnant, have existing health conditions or are using medications, we recommend you seek medical advice prior to use
  • If you are currently or have recently been unwell, we do not recommend you using these facilities and seek medical advice prior to use
  • It is not recommended to use these areas if you are fasting, or have not maintained hydration and/or nutrition
  • Please ensure you stay well hydrated when using the spa, sauna and/or steam room
  • It is safer not the use the spa, sauna and/or steam room alone
  • It is recommended that you limit your use in these areas to 10-minutes at any one time.
  • It is also recommended that you have a 10-minute break before re-entering any of these areas
  • Immediately Report to a staff member if you or someone else is feeling unwell
  • Please respect staff and patrons, by being considerate of your behavior, noise level and language
  • Please report any suspicious activity to our staff
Spas, Sauna and Steam Room - Health and Hygiene
  • If you or someone in your care has been unwell with stomach related symptoms including diarrhea in the past 14 days, please do not use our pools, spa, sauna and/or steam room
  • Please shower with soap and water before using our pools, spa, sauna and/or steam room
  • People who suffer from incontinence must wear waterproof nappies pants or swimwear
  • Please dispose of used nappies in dedicated nappy bins
  • Please wash your hands thoroughly with soap and water after using the toilet or changing a nappy
  • Please notify our staff urgently is a toilet accident occurs
  • It is recommended that you sit on a towel whilst in the sauna and/or steam room
