Please read the following and accept the terms and conditions below:
1. Our agreement
These terms are a membership agreement between you and Hume City Council Leisure Centres (Hume City Council – ABN 14 854 354 856).
1.2 It is important that you have read and understood all the terms and conditions of the Agreement before agreeing to these terms.
1.3 It is also important that you understand that by signing up to this agreement you agree to the following stipulated terms and conditions.

2. General Terms
2.1 By entering any Hume City Council Leisure Centre, you agree to comply with the terms and conditions of entry, which are displayed at the main entrance and throughout these facilities, and relevant signage which may be erected within the facility. This includes signage outlining behaviour requirements around swimming facilities
2.2 Inappropriate behaviour by a member which is deemed by management likely to lead to injury, harassment or embarrassment to any member or employee of Hume Leisure, or damage to any equipment or building belonging to Hume Leisure may see the member suspended from use of the facility with no refund of fees or extension to their term of the membership.
2.3 User groups are not to provide direction to members of the public, rather notify a Hume Leisure staff member if they have any issues.
2.4 At all times while within a Hume City Council Leisure Centre, you will comply with the reasonable direction of all staff members.
2.5 Discrimination or physical and verbal intimidation towards staff or fellow users will not be tolerated and may lead to exclusions from the facility.
2.6 Smoking and vaping is prohibited in all Hume City Council facilities. The consumption of or being under the influence of alcohol within the centres or their grounds is not permitted. Users under the influence of alcohol or drugs may be asked to leave the facility if their behaviour presents a risk to the reasonable comfort or public safety of users.
2.7 Any matter where a person is suspected of consuming or trafficking illegal substances will be referred to the police. Any member found committing a crime on the premises of any Hume City Council Leisure facility will have their membership cancelled immediately and the matter will be referred to the police.
2.9 A breach of any condition of this membership may result in the immediate suspension or cancellation of your membership by management.
2.10 Safety regulations and usage guidelines posted throughout the facility relating to various facilities, equipment or activities must be observed and followed at all times.
2.11 Users creating a disturbance by engaging in disruptive conversation above normal conversational noise levels; deliberately making excessive noise; shouting or talking in a disturbing fashion; or gratuitously using profanity or engaging in other disruptive conduct that constitutes a nuisance to other individuals will be asked to leave.
2.12 Management reserves the right to alter or amend the conditions of the membership with 14 days’ notice.
2.13 No clause or term in these conditions is intended to exclude the operation of any condition or warranty implied by the Competition and Consumer Act 2010 and any such claim or term, if any, shall be severable and of no force or effect.
2.14 Personal property cannot be held at reception, and no responsibility will be taken for property brought into the centre. Lockers are available free-of-charge to members and a fee to non-members. Lost locker keys will incur a replacement fee.
2.15 Hume City Council equipment remains the property of each Leisure Centre and must not be used unless by prior agreement. Personal equipment and individual training bags cannot be stored on site.
2.16 When you use our facilities, you acknowledge all risk which is inherent with the use of swimming facilities and will take reasonable care.
2.17 Users of the facility are required to wear appropriate attire and have clean personal hygiene. Users exhibiting bodily hygiene that is so offensive as to constitute a nuisance or health hazard to other individuals in the facility will be asked to leave.

2.19 Permission is required to be sought prior to taking photographs, audio and video recordings of individuals/groups/children. Filming/video recordings require the approval of Hume City Council’s Marketing Department.
2.20 Items for public display, including and not limited to brochures, flyers, and signs must be approved by facility management.
2.21 Any hirer providing instruction and/ or supervision of participants are required to provide copies of appropriate qualifications of staff and/ or volunteers who will be responsible for that instruction and/ or supervision.
3. Health and safety
3.1 When you use our facilities, we expect you to be medically sound to undertake physical activity. If you are unsure, please seek medical advice from your doctor.
3.2 You agree to advise us of all relevant personal, health and fitness information before and during any exercise program or other activity which may affect your ability to use facilities or exercise equipment within the centre.
3.3 You warrant that information you give us will be true and accurate and not otherwise misleading to the best of your knowledge.
3.4 You agree to not use our facilities if you are suffering from any form of illness, disease, injury or other condition that could be a risk to your health or safety, or that of other members and guests.
4. Centre closures
4.1 For a variety of reasons, we may be required to close our centre or prevent access to an area for a period of time.
4.2 If this occurs, we will communicate your membership options and access.
4.3 We will make every effort to advise you about changes in membership conditions, or facility closures via email, phone, on our website and/or across our social media platforms with 14 days’ notice.
5. Water Safety
5.1 Parent/Guardians must actively supervise their children in the water in line with the Centre’s “Watch Around Water” safety program.
5.2 Children under 5 – must be fully supervised and remain within arm’s reach of an adult/guardian (16 years or older) and wear a pink wristband provided by staff.
5.3 Children 5-9 – must be accompanied into the facility and constantly supervised by a parent/guardian (16 years or older) and wear a yellow wristband provided by staff.
5.4 Children who are not supervised will be removed from the water.
6. Fees
6.1 Any fee increases from 1st July annually will be reflected in Hume City Council’s Fees and Charges Schedule.
7. Program Delivery Support & Staffing Requirements
Program Suitability & Participant Needs
7.1 Schools must disclose any specific participant needs (e.g. physical, cognitive, behavioural) that may require additional support during aquatic sessions.
7.2 This information must be provided at least two weeks prior to the commencement of the program to allow for appropriate planning and staffing.
Additional Staffing Requirements
7.3 Where participant needs exceed the standard supervision ratio, schools may be required to provide additional staff or support personnel to ensure safe and effective program delivery.
7.4 The decision to request additional staffing will be based on:
- The nature and extent of participant needs.
- Risk assessments conducted by our team
- Observations from previous sessions (if applicable).
- Alternatively, the swim school may provide additional swim teachers to meet safety requirements, subject to availability and at an additional cost.
Program Adjustments
7.5 In cases where adequate support is not provided, we reserve the right to:
- Modify the program to suit available resources.
- Decline participation if safety cannot be assured.
8. Agreements
8.1 Any proposed changes to agreements must be submitted in writing to relevant booking officer. Change requests should include a detailed explanation of the proposed modifications.
8.2 All requested changes will be reviewed by Hume City Council. Approval or rejection of the requested changes will be communicated to the requesting party within 14 days of receiving the request.
8.3 Any booking cancellation needs to provide 72 hours’ notice, or a fee will apply.
INSURANCE AND INDEMNITY FOR HIRE AGREEMENTS – GENERAL USE.
Liability Insurance
The Hirer agrees during the term of this Agreement, to be the holder of a current Public Liability Policy of insurance in respect of the activities specified above in the name of the Hirer providing coverage for at least $20m. The Public Liability shall cover such risks and be subject only to such conditions and exclusions as are approved by the Hume City Council and shall extend to cover the Hume City Council in respect to claims for personal injury or property damage arising out of the negligence of the Hirer.
Indemnity
The Hirer agrees to indemnity and to keep indemnified, and to hold harmless the Hume City Council, its servants and agents, and each of them and against all actions, costs claims, charges, expenses, penalties, demands and damages whatsoever which may be brought or made or claimed against them, or any of them, arising from the Hirers performance or purported performance of its obligations under this Agreement and be directly related to the negligent acts, errors or omission of the Hirer.
The Hirer’s liability to indemnity the Hume City Council shall be reduced proportionally to the extent that any act or omission of the Hume City Council, it servants or agents contributed to the loss on liability.
