Questions with regard to chairs, tables, heating, lighting etc, should be discussed with the Centre’s Booking Officer prior to your function as per the above listed conditions of use and hire. If you have lost or misplaced your keys, you must contact the Council immediately. Council’s after hours service will not open any Centre. Note: The telephone number - 9205 2200 should be used for situations that need immediate attention i.e. a broken window, if you are unable to lock or secure the building or loss of power etc. 

CONDITIONS OF USE AND HIRE AGREEMENT

Please read this document carefully and sign that you understand the conditions of use. 

2 PURPOSE 

The purpose of this document is to outline the conditions associated with the hire of a Hume City Council Community Centre. Under no circumstance is the hirer permitted to sub-let any room/space within the Centre. 

3 BOOKING PROCESS 

Initial booking enquiries may be made by contacting the Centre’s booking staff by telephone, email or in person. The information required to assist the intended hirer with their enquiry covers the day/s, time, purpose, numbers of attendees, room or rooms, name and contact details and the type of entity seeking to make an application. From your initial contact booking staff will assist in furthering your enquiry by providing a copy of the Booking Application together with a copy of the Conditions of Use and Hire Agreement, Fees and Charges and Emergency Preparedness and Response Procedure. The booking process consists of three stages which are in brief: 

3.1.1 A tentative or ‘on hold’ booking may be registered and held for a period of two working days. 

3.1.2 A fully complete, signed Application and Conditions of Use and Hire Agreement, COVID Plan, must be submitted to make a booking. 

3.1.3 If the hirer’s application is successful, Council will issue a written booking confirmation. Note: No changes accepted to the booking two weeks prior to the event. 

4 APPLICATION

All information relating to the booking must be provided on the appropriate Booking Application Form. Within the application you must state the purpose of the use, room/s required, the number of attendees, the day and times required. Should your booking details change at any time you must notify the Centre’s Booking Office in writing, as soon as possible. Failure to state the exact nature of your function may result in the loss of bond and future hire disallowed. Where the application is made on behalf of an organisation, the application shall state the name of the organisation and the authority of the applicant for making the application. The signed Agreement must be submitted to the Centre’s Booking Office and payment made within 14 days of invoice. By lodging the signed Booking Application, you acknowledge that you have read, understand and agree to the Conditions of Use and Hire Agreement.

5 BOOKINGS

Should a prospective hirer wish to view the facility they must make an appointment with the booking officer. Individuals and groups are not legally permitted to use the Centre until an agreement is made in writing. Individuals, clubs/groups utilising the Centre do not have the authority to book the facility to any other club, group, organisation or user. Under no circumstance is sub-letting allowed and bookings cannot be transferred or reassigned. Hirers who do not correctly state the exact nature of the hire, or who do not meet the Conditions of Use and Hire Agreement will have the agreement terminated. If these conditions are not met, then the hirer/user may incur a financial penalty and jeopardise further hire of Council’s facilities. Facilities will only be hired to responsible persons 18 years of age or older. Security guards may be required for some functions – more information can be provided at time of booking. ‘Tentative bookings’ or ‘bookings on hold’ will be held for a period of two working days only. It is the responsibility of the hirer to confirm the booking within the two-day period after which the space will be released and made available to others for hire. See ’Cancellation’ 6 HIRE EXCLUSIONS The hirer shall only use shared areas and the space/s hired. Council reserves the right to let any other portion of the Centre for any purpose/s at the same time. The hiring of rooms does not include general consumables.

7 HIRE PAYMENTS 

7.1 Fees and Charges

7.1.1 Annual fees and charges for the use of all Council facilities are established in Hume City Council’s Schedule of Fees and Charges. A copy can be obtained on request.

7.1.2 All hire charges payable will be those in effect at the time the Centre is used.

7.1.3 Fees are subject to change and are to comply with Council’s pricing policy.

7.1.4 GST is applicable to all hire fees, excluding security bonds. Should the hirer lose the security bond due to these conditions not being met, GST will be charged on the amount fined.

7.2 Invoices

7.2.1 All accounts must be paid in full prior to the event.

7.2.2 Outstanding monies, not paid within the timeframe, may result in keys being withheld or recalled and access denied to the user concerned.

7.2.3 Where a community group experiences difficulty making the required payment, the hirer agrees to contact the Centre’s Booking Office immediately. Early contact under these circumstances will provide an opportunity to arrange for an agreed payment plan.

7.2.4 Access will be suspended where fees are not paid within the allocated timeframe unless prior approval has been granted by Council in writing.

7.3 Users

7.3.1 The hire charge must be paid not less than 28 days before the date on which the Centre will be used, or immediately upon booking should this be less than 28 days.

8 SECURITY BONDS

8.1 Permanent User

Permanent hirers must pay a bond, which will be held in trust, until the group ceases to use the

Centre, in addition to one month's hire. 8.2 Casual Users 8.2.1 A security bond must be paid upon Invoice. If the security bond is not received, the booking will be regarded as not confirmed and may be cancelled without notice. The security bond will apply as:

(i)A guarantee of compliance with these conditions;

(ii)A security against damage to, or loss of Council property including any key/s issued, or damage to or loss of the property of a permanent user,

(iii)A security against the cost of any additional cleaning required by the Council as a result of your use/hire.

8.2.2 The hirer will be liable to pay any further amount greater than the security bond to meet the full cost of repairs to and replacement of either Council property or that of a permanent user/hirer and/or additional cleaning costs. The Council’s decision as to the amount to be paid will be final.

8.2.3 If these conditions are not met only a balance of a security bond, after deduction of the amount referred to in (8.2.1) and (8.2.2) above, will be refunded to the hirer.

8.2.4 Where it is not necessary to deduct any cost referred to above, the full security bond will be refunded by cheque to the hirer. Bond receipts are to be kept by the hirer for application of bond returns. Once requested, hirers are advised to allow a period of four to six weeks for a refund to be processed.

9 CANCELLATION

9.1 Cancellation by Council

9.1.1 When in the opinion of the Council, the state of the facility is such that it is not safe and should not be used, a cancellation of any scheduled activity may be required.

9.1.2 A decision of Council to cancel a scheduled activity, overrides that of any organisation or hirer.

9.1.3 The hirer hereby agrees to accept the decision of the Council and to be held to have consented to the cancellation and to have no claim at law or equity for any loss or damage caused by the cancellation.

9.1.4 The Council may cancel any booking made by reason of national or district emergency. In this circumstance any hire charge and security bond (if applicable) will be returned in full, but Council will not be liable for any loss incurred by the hirer.

9.2 Cancellation by Hirer

Council must be notified of all cancellations in writing.

9.2.1 Any hire charge and security bond will be returned in full upon the condition that notification of such cancellation is received by the Council, in writing, at least one calendar month prior to the scheduled activity date. Hirers are advised a period of 4 – 6 weeks is required for a refund to be processed.

9.2.2 If a cancellation is received within a period of 14 working days of the scheduled activity date, all fees will be forfeited.

10 BUILDING CODE 

10.1 Compliance Hirers, including all persons associated with the hirer’s activity, must comply with all aspects of the Building Code, Fire Regulations, the Child Safety Standards and the Centre’s Code of Conduct. 

10.1.1 Floor plans and Fire Evacuation procedures displayed throughout the Centre are to be followed in case of an emergency. 

10.1.2 At the commencement of each activity, the person in charge of the session must make participants aware of emergency procedures, exits and marshalling points.

10.1.3 Room capacities are limited and must not to be exceeded.

10.1.4 The hirer shall comply in every respect with regulations under the Health Act regarding public buildings for the prevention of over-crowding, obstruction of fire exits, corridors, passages and any other part of the building. Council reserves the right to cancel or suspend any booking should the hirer, including all persons associated with the hirer’s activity, not adhere to instructions given by the Centre’s staff.

10.1.5 Fire exits and pathways cannot be obstructed at any time.

10.1.6 Where a fire brigade/security company is called as a result of the hirer’s activity, all expenses incurred will be paid by the hirer. Currently, estimated to be $3,000 for a fire call.

11 DECORATIONS

11.1.1 Stage assembly, dance floors, electrical installation, appliances, banners, and decorating materials or like items cannot be installed or erected without authorisation from Centre Management. These items remain the responsibility of the hirer and must be removed within the booked use of the facility. Hume Council staff are not able to assist with these items.

11.1.2 At no time can the hirer use sticky materials on the walls that will require repair – if this does occur costs will be forwarded to the hirer to repair the surfaces affected. 

11.1.3 The use of flammable materials or items (eg bales of straw/hay) for decorations is strictly prohibited. 

11.1.4 Smoke machines, open flames and helium balloons are not allowed in the centre. 

11.1.5 Jumping castles/play gyms are not allowed at the Centre. 

12 CLEANING 

12.1 Responsibilities It is the responsibility of the hirer to ensure that the Centre/space is maintained in a clean, safe and tidy state at all times. 12.1.1 Where in the opinion of the Centre Leader the Centre/space has not been left in an acceptable state, the cost of reinstatement will be paid by the hirer. 

12.1.2 Where facilities are shared, it is the responsibility of the joint hirers to make the necessary arrangements to ensure that those facilities are maintained in a clean and tidy state at all times. 

12.1.3 Adhesive or sticky material is not to be placed on any wall, window, light fitting or ceiling within the Centre. 

12.1.4 All rubbish, leftover food and drink must be removed from the Centre and placed in the appropriate bins provided. If the bins are full, it is the responsibility of the hirer to remove their rubbish from the site. Any food or drink left on the premises will be disposed of and the hirer charged accordingly. 

12.1.5 All furniture is to be left in a clean, safe and orderly state prior to leaving the premises. 

12.1.6 All equipment used for specific activities must be removed or packed away in a safe and orderly state at the completion of your activity.

12.1.7 All floors in rooms used are to be swept and cleaned thoroughly. Where the hire includes a Kitchen space then the Kitchen floors are to be mopped. 

12.1.8 Any safety tape laid on the floor should be removed immediately. 

13 KITCHEN, COOKING AND CATERING

It is the responsibility of the hirer, including all persons associated with the hirer’s activity for example a caterer, to ensure the Centre’s Conditions of Use and Hire Agreement is met. 

13.1.1 Safe cooking is to be undertaken using the appliances installed in the community kitchen only. 

13.1.2 Gas and electrical cooking appliances such as spit roasts, hotplates, portable cookers deep fryers or toasters not supplied by the Council, are not to be taken into or used within the Centre. 

13.1.3 Where use of the Kitchen forms part of the booking, the hirer and all persons associated with the hirer’s activity must ensure: 

(i)The activity undertaken does not result in the emission of smoke or fumes that activate smoke detectors. Where a fire brigade call was a result of the hirer’s activity all expenses incurred will be paid by the hirer. Currently estimated to be $3,000

(ii)Prior to leaving the premises, all kitchen benches, surfaces and appliances are to be cleaned inaccordance with Food Safety Procedures and power turned off. An extra cleaning charge will apply if the hirer misuses or leaves the kitchen areas untidy or in an unhygienic state.

13.1.4 If your event will include the selling of food and / or drinks you will require a Streatrader licence and the licence will need to be sent to the booking officer prior to your event.

It is the responsibility of the hirer to ensure that caterers adhere to these conditions.

14 COMPLIANCE

The hirer, including all persons associated with the hirer’s activity, shall comply with all directions, instructions or requests given by Council’s Centre staff related to the proper use and reasonable comfort and rights of other users and the general public when using the Centre. Each hirer will be requested to read the Hirer’s Guide and Emergency Preparedness and Response procedure documents and acknowledge by signing that the document was received.

15 DAMAGE

Any damage caused to or loss of property, fittings, walls, floors or equipment must be reported immediately to Council’s Centre staff detailing how the damage/loss was caused so that it can be determined who will be responsible for paying for the repair or replacement of Council property. The hirer agrees and accepts that the Council’s determination is final.

16 FIRE EXTINGUISHERS

Fire extinguishers are provided within the Centre and are for emergency use only. Should an extinguisher be stolen or tampered with, by a member or participant of any program or function, then the hirer is liable for cost of replacement or damage.

17 MAINTENANCE

All maintenance items should be reported immediately to the Council’s Centre staff.

18 KEYS AND ALARMS

The Centre has a restricted key system limiting the duplication of keys.

18.1.1 After-hours and weekend hire access requires the hirer/user to make an appointment to complete an induction and appropriate key/s will be issued.

18.1.2 Any key/s issued are to remain in the control of the hirer (or responsible person 18 years or older nominated by the hirer).

18.1.3 The hirer is responsible to ensure that the Centre is secured at all times. Should the Centre be left unsecured, doors unlocked and/or alarm not set, the hirer will be deemed responsible for any damages and charges.

18.14 All keys issued are to be returned the next business day after the function or meeting date.

18.1.5 Alarm Instructions will be issued when keys are collected. The hirer is liable for any cost incurred as a direct result of those instructions not being followed. Should authorised hirers experience any difficulties with security systems they should contact Hume City Council’s After-Hours Service on 9205 2200.

18.1.6 A replacement fee of $100 will be payable by the hirer if keys are lost, damaged or not returned.

19 EXTRA CHARGES

Additional charges will apply for each hour or part thereof, if the hirer/user exceeds the agreed timeframes for the hire of the Centre. 

20 ANIMALS ARE BANNED 

No unauthorised animals can enter Centre except those permitted by Law. 

21 GAMBLING 

Games of chance (either directly or indirectly), which includes money/valuables passed as prizes, are not allowed in any portion of the Centre without prior Council approval. 

22 GOOD ORDER: CODE OF CONDUCT 

The hirer and any person associated with the hirer’s activity will act in accordance with the Centre’s Code of Conduct. Behaviour or activities that would cause a risk to the reasonable comfort or public safety of others, including obscene language, insulting or discriminatory remarks and disorderly behaviour, which may cause damage to property or offence to other users of the Centre, will not be tolerated. The hirer is responsible for the behaviour of all persons associated with the hirer’s activity including facilitators, caterers, participants and guests. Council reserves the right of Council Centre staff to ask offenders to leave the Centre and any associated costs will be forwarded to the hirer. 

CODE OF CONDUCT 

The Code of Conduct is a statement of the way that all users of Greenvale Recreation Centre will conduct themselves when they are within the facility. 

Tenants, visitors, guests and participants of Greenvale Recreation Centre services, programs, or events are expected to adhere to the following:

1) Staff and fellow users should be treated with courtesy and respect.

2) Facilities and equipment should be treated with respect and used in an appropriate manner.

3) Parents/guardians must remain on the premises at all times while children are in the Centre. Children must be supervised by an adult at all times.

4) Minors under the aged of ten must be closely attended by an adult.

5) Safety regulations and usage guidelines posted throughout the facility relating to various facilities, equipment or activities must be observed and followed at all times.

6) Discrimination or physical and verbal intimidation towards staff or fellow users will not be tolerated and may lead to exclusions from the facility.

7) Users creating a disturbance by engaging in disruptive conversation above normal conversational noise levels; deliberately making excessive noise; shouting or talking in a disturbing fashion; or gratuitously using profanity or engaging in other disruptive conduct that constitutes a nuisance to other individuals will be asked to leave.

8) Smoking/vaping and use of illegal drugs is prohibited in all areas of the facility including the outdoor grounds and main entrance.

9) Users under the influence of alcohol or drugs may be asked to leave the facility if their behaviour presents a risk to the reasonable comfort or public safety of users.

10) Users of the facility are required to wear appropriate attire and have clean personal hygiene. Users exhibiting bodily hygiene that is so offensive as to constitute a nuisance or health hazard to other individuals in the facility will be asked to leave.

11) Permission is required to be sought prior to taking photographs, audio and video recordings of individuals/groups/children. Filming/video recordings require the approval of Hume City Council’s Marketing Department.

12) If an accident, injury or robbery occurs, report it to facility staff immediately. A written report should be filed within 24 hours to the Centre Leader.

13) Items for public display (e.g. brochures, flyers, and other materials) must be approved by facility management.

Failure to adhere to the code of behaviour may result in expulsion from the facility by the Centre Leader (or their delegate). If the person does not leave, the staff will call 000 to have the person removed. These persons may be banned from future use of the facility, either temporarily or permanently, depending on the nature of the incident. 

23 HEATING/COOLING 

The Centre is equipped with a heating and cooling system. Further information is available when keys are collected. No extra heaters/coolers are to be used or brought into the Centre. All equipment is to be turned off after use and returned to their allocated space. Council's equipment is not to be removed from the Centre and charges will apply for loss/damage.

24 INSURANCE 

Hirers are required to hold Public and Products Liability Insurance to the value of $20,000,000. The hirer shall supply a copy of a Certificate of Currency for Public Liability Insurance providing coverage of at least $20,000,000 together with the signed Conditions of Use and Hire Agreement. The Council may offer Public and Products Liability Insurance to individuals and organisations that do not hold a public liability policy. The policy applies only to one hire session, provides an indemnity for $20,000,000 and is subject to a contribution of $2500 which must be paid by the hirer for each and every claim. The cost of this insurance is currently $19 per session. 

25 LIGHTING 

In the case of power failure, the use of candles, Tilley and or any Kerosene Lamp or naked flame is strictly banned. All lights are to be turned off prior to leaving the premises. All entries and exits are illuminated and variation to the lighting cannot take place. 

26 LIQUOR 

Hirers proposing to serve liquor as part of the use of the Centre are required to obtain approval from Council, and if required, obtain a Limited Liquor Licence from the Liquor Licensing Commission or local Police Station. The Limited Liquor Licence must be presented to the Centre’s Booking Officer when submitting the appropriate booking forms. Applicants for such a licence should allow at least two to three weeks for the Commission to process their application. 

27 NOISE 

Hirers are to ensure that noise coming from the Centre is not a cause for public annoyance and that all noise pollution regulations are complied with. Loud noise (i.e. at such a level that neighbours are disturbed) may result in the Council’s retention of part or all, of the security bond.

28 PARKING

Any motor vehicle driven or parked in the confines of the Centre is entirely at the owner’s risk, and no responsibility is accepted by Hume City Council for any theft or damage.

Vehicles must be parked in designated parking areas only. All restrictions are enforced.

29 PERFORMING RIGHTS 

In the case of a dramatic performance, a concert, a visual/verbal art presentation or like presentation, the hirer will not present, perform or permit to be presented/performed any dramatic, musical or other art presentation / performance or activity without the appropriate copy rights. The hirer agrees to indemnify Council against any claim for breach of copyright or any associated action. 

30 POLICE ATTENDANCE 

The hirer will, when directed by Council Centre Staff or if appropriate and/or necessary, arrange for Police attendance/presence during their event. If required, the hirer agrees to register the function with the Victorian Police Party safe Program. 31 REFUSAL TO LET - BREACH OF CONDITIONS OF USE 

Hume City Council reserves the right to affect the following actions: 

31.1.1 To refuse an application where any provisions contained in these Conditions of Use and Hire Agreement have not been met or have been abused by the applicant. 

31.1.2 To refuse an application where the activity connected with the hire is unlawful, considered a high risk, offensive or may cause a public disturbance or loss of amenity and/or likely to be a threat to public safety. 

31.1.3 To terminate a booking/s or hire, and/or terminate a hire arrangement, and/or evict any person/s deemed affected by alcohol or drugs, or if the purpose of the hire is falsely represented. 

32 ROOM CHANGES 

Council reserves the right to change allocated rooms in order to accommodate other bookings provided the room change still matches the requirements of the booking. 

33 SECURITY 

It is recommended to have Security present at an event at any of the Council Facilities. You are welcome to engage a security provider of your choice and register the function with the local Police station with a receipt to be presented to the booking staff. Alternatively, Council can make the necessary arrangements with costs covered by the client. The number of security staff required is as follows: Up to 100 guests (no alcohol) = 1 guard, and 1 guard for every 100 people thereafter. Up to 100 guests (with alcohol) = 2 guards, and 1 guard for every 100 people thereafter. Security is booked for a minimum of 4 hours. Please note that security is compulsory for all functions held on 31 December. You are required to provide proof of identity if requested by a security guard or a council officer. 

34 SMOKING/VAPING IS BANNED 

Smoking/vaping is not allowed within five metres of the Centre. It is the hirer’s responsibility to inform all persons associated with the hirer’s activity about the Council’s Non-Smoking Policy.

35 THEFT 

Neither Hume City Council nor its staff or agents shall be held liable for any loss or damage sustained by the hirer. It is the responsibility of the hirer to secure any articles of value that either they (or persons associated with the hirer’s activity) bring into the Centre. Articles stolen, damaged or lost will not to be replaced or reimbursed by the Council. 

36 ATTENDANCE OF EMERGENCY SERVICES 

When Fire Brigade or Security Contractors attend your event due to a false alarm or non-compliance of the conditions a fee will be deducted from your bond. This could take a few weeks as services tend to invoice incidents after 4 weeks. The service could also ask for ID when attending your event. 

37 EMERGENCY NORMAL AND AFTER HOURS 

37.1.1 The senior Emergency Control Organisation may be in attendance. If Wardens are in the area or in the building, they shall coordinate the emergency in accordance with the Centre’s current Emergency Evacuation and Preparedness Response Procedure.

37.1.2 Where there are no Wardens present, for example, after normal working hours, any person who detects an emergency should comply with the requirements below:

Assist any person in immediate danger, if safe to do so, and isolate the emergency by closing the door.

•Call emergency services on 000 and provide the details of the emergency and location of the building.

▪If calling from an internal building phone, dial ‘0’ first for outside line

(i.e. dial ‘0000’ from an internal building phone.)

•Determine if any action can be taken to minimise the effects of the emergency (e.g. extinguish a small fire) if trained and confident and safe to do so.

•Alert persons in the area or on the floor that there is an emergency.

•Assess whether an evacuation of the area, floor and/or building is required proceed to the nearest safe emergency exit stairwell.

•Ensure the emergency services have been notified of the emergency.

•Evacuate the building and assemble at the primary external emergency assembly area (unless unsafe todo so – otherwise to the secondary assembly area) and wait for the emergency services to arrive.

Ensure Emergency Services are advised of any available information relating to the emergency i.e. if there are people in the building or, if it is unclear, whether the building has been fully evacuated.

38 COVID SAFE TERMS AND CONDITIONS

Hume’s Community Centres are committed to provide safe, inclusive and accessible spaces. Due to the pandemic and to ensure COVID-Safe Restrictions applicable to Hume City, are complied, extra terms & conditions have been included within this Agreement. These conditions are based on the gradual easing of restrictions. Note: Conditions may change without notice, and must be complied with in accordance with the Restrictions applicable at the time of use / hire:

38.1 MY BOOKING

•I understand I can have no more than the capacity of the room hired at my session/booking at any given time.

•All information relating to my booking is accurate and I understand that I cannot use the facility for any other purpose other than outlined in the booking application.

•Users who fail to correctly disclose the exact nature, or proposed use of the facility may result in loss of the ability to use a Hume facility in the future.

38.2 SOCIAL DISTANCING

•I will ensure that I, my staff and all participants/attendee’s will adhere to social distancing regulations and have a social distancing guideline on hand throughout my booking duration.

The rules and regulations at the time of production are:

•Room capacity applies to all spaces. Please check at the time of booking.

•Keep a minimum distance of 1.5 metres away from one another.

•Ensure that every person entering the building Registers, preferably by scanning the QR Code or records their attendance, by providing full name and phone number, date and time entering the building. The applicant is required to retain and make available any manual listing of attendee’s, if required, for the purpose of contract tracing, for a period of 28 days following the date of the building’s use / hire.

38.3 Health, Safety and COVID-Safe Precautions

Hand sanitiser is available throughout the building and you are requested to:

•Advise your guests to use hand sanitiser and practice good hygiene.

•Not shake hands

•Allow for extra time between arrivals/appointments to avoid queuing

•Not congregate in groups in or around communal spaces

38.4 CLEANING

Council will provide a cleaning kit in each room which includes essential cleaning products to clean and disinfect all frequently touched surfaces such as tables, chairs, doorknobs etc.

It is the responsibility of the client to clean and disinfect all frequently touched surfaces before and after each booking. If your booking is by appointment you will also be required to wipe down all areas touched between each appointment.

The following steps are to be taken as recommended by the Department of Health & Human services:

•Wear gloves when cleaning and disinfecting. Gloves should be discarded after each clean. Clean hands immediately after removing gloves.

•Thoroughly clean surfaces using detergent (soap) and water.

•Apply disinfectant to surfaces using disposable paper towel or a disposable cloth.
